2AGAIN - TERMS OF USE
1. Acceptance of terms
1.1 2Again is a dating service owned and operated by 2Again ApS (after this "2Again").
1.2 These Terms of Use (after this the "Terms") for the use of the services on the 2Again App (after this the "App") and 2Again's web application, https://2again.com/, (after this the "Application") (collectively, the "Services") govern the relationship regarding use of the Services between you as a user and 2Again. In the Terms "we", "us", and "our" refer to 2Again.
1.3 It is a condition of the use of the Services that you accept the Terms. Otherwise, you will unfortunately not be able to use the Services.
1.4 When you use the Services, your personal data will be processed in accordance with our Privacy Policy.
2. About 2Again
2.1 2Again is an innovative and different dating service, launched worldwide and in more than 20 languages, which uses different tools than other dating services on the market, including the ability to contact profiles you have not matched up with beforehand, send paid messages and virtual gifts to other users, and earn "coins" that can be converted into real money.

3. Creating a profile
3.1 To use the Services, you must create a profile. You must be of legal age, i.e., 18 years or older, to create a profile on the Services.
3.2 You can create a profile by giving your first and last name, gender, date of birth/age, country, phone number and email address, or you can create a profile using your log-in information for Google, or Facebook. You can also choose to provide other personal data in your profile. The profile you create is for your own personal use. See more about 2Again's processing of personal data in our Privacy Policy.
3.3 You warrant that the information in your profile is correct. At the same time, you are obliged – to the extent possible – to continually update the information in your profile so that the information is current and always correct. If you provide incorrect information, 2Again may choose to suspend or delete your profile, and this will be a breach of the Terms.
3.4 2Again cannot be held liable for the consequences of incorrectly entered and entered information.
3.5 Your password is personal, and you are obliged to treat and keep the password confidential, not to disclose it to others or otherwise allow others to access the password. Also, pay attention to the use of your password on publicly available or borrowed devices. 2Again stores your password in encrypted form. If you have forgotten your password, this can be reset via the features of the Services.
3.6 If you experience misuse of your password or profile, you must immediately change your password and subsequently contact 2Again using the contact options in the Services or via the contact form at https://2again.com/.
3.7 2Again may require you to validate your identity to 2Again in a certain way. This may, for example, be in connection with the creation of a user profile or in connection with payment.
4. Services in the Services
4.1 2Again operates a global business and provides services to a diverse community of users. Our pricing structure may vary from country to country and depend on the duration of the subscription, distribution channels, and so on. We periodically test new features and offer users more functionality as well as free or paid features that they can opt-in or out of as needed. We may also change or discontinue offering certain types of purchases at any time.
4.2 Free features
4.2.1 When you sign up for the Services, you get instant access to free features. These features are subject to change.
4.2.2 The free features and functionality include, in particular, your creation of a profile, certain search functions, receipt of individual partner suggestions, and receipt of digital coins.
4.3 Paid features
4.3.1 Recurring subscriptions and/or one-time purchases provide access to more features and functionality. You can find information about these paid services in the Services before completing your purchase.
5. Purchases in the Services
5.1 Depending on your location and the way you use the Services, for example, via PC, a web mobile version or an app on iOS or Android systems, purchases can be made via direct billing, for example, via a payment card, PayPal, or similar or payment systems in apps such as the App Store or Google Play.
5.2 If you choose to complete a purchase, you will be asked to confirm your purchase with that payment provider and the chosen payment method, for example, debit card or a third-party account, for example, the store's, will be charged with the price displayed for the purchase(s) you have made and you give 2Again and/or Google or another third-party provider permission to charge you for this amount.
5.3 Your purchase is confirmed at the time your financial transaction is approved and verified by your bank or provider of a third-party account, such as Google.
5.4 Automatic subscription renewal
5.4.1 If you purchase a subscription, including a VIP subscription or Big Spender subscription, you will be charged for the subscription until the end of your current subscription period via the selected payment method. After your first subscription period and after any subsequent subscription period, your subscription will automatically continue for an additional corresponding period unless otherwise expressly stated at the time of purchase. When you purchase a subscription, you are contractually obligated to continue to make any recurring payment throughout the subscription period as well as ongoing renewal periods until you have terminated the automatic renewal of the subscription.
5.4.2 Some subscriptions can be linked to offers where the price is reduced for a period before the subscription is renewed at the standard price. You will be informed of this in connection with the acceptance of the subscription.
5.4.3 Objections to a payment that has already been completed must be sent to 2Again via our contact option under clause 2.2 if 2Again has made the direct debit, or Google, or another relevant third-party provider, depending on how your purchase is made.
5.4.4 You can withdraw your consent to automatic card payments at any time. However, please note that you are still required to pay any amount you have yet to pay until the subscription has expired if you have also cancelled the automatic renewal of your subscription. Depending on how you have subscribed, it may be necessary to access, for example, your Google account and cancel.
5.5 Right of withdrawal after purchase – purchase via the web version
5.5.1 Under applicable law, you have 14 days from the day following the purchase to exercise your right of withdrawal if you have purchased a subscription via the web version of the Services on 2again.com. You can exercise your right of withdrawal by contacting 2Again via our contact option under clause 2.2. The refund will be paid within 14 days from the date 2Again was notified of your decision that you withdraw from your purchase agreement and will be processed using the same payment method that you used for the purchase.
5.5.2 If you use the Services before the end of the withdrawal period, including swiping in profiles or liking profiles, this is considered to be an express wish on your part to get immediate access to the Services, and thereby your right of withdrawal under section 18(13) of the Danish Consumer Contracts Act lapses.
5.6 Right of withdrawal after purchase – purchase via Store
5.6.1 If you have purchased a subscription through the Store that you wish to cancel after purchase, cancellations, right of withdrawal, and refunds will be processed by store according to their own terms and conditions, which we have no influence on. To request a refund, sign in to your store ID and follow cancellation and refund instructions.
5.6.2 If you purchased your subscription through Google Play that you wish to cancel after purchase, cancellations, right of withdrawal, and refunds will be processed by Google according to their own terms and conditions, which we have no influence on.
5.7 You should be aware that if you delete your profile with 2Again or the App itself, this does not mean that your subscription has been terminated with either 2Again, Google, or another relevant third-party provider.
5.8 Virtual items
5.8.1 2Again offers the purchase of virtual items. If you choose to purchase virtual items in the Services, this is done through Google Play, or another application platform approved by 2Again. Your account with Google, or the applicable application platform will be charged for the purchase in the Services in accordance with the terms applicable to purchases through those platforms. VAT may be charged depending on where you live.
5.8.2 The purchase of virtual items that can be used in the Services is a digital service that begins immediately upon receipt of your purchase of such virtual items. You acknowledge that 2Again is not obliged to refund any payments of virtual items and that you will not receive any money or other compensation for unused virtual items if your user profile is closed, whether voluntarily or involuntarily. You waive your right of withdrawal in connection with the purchase of the virtual items.
5.9 Conversion to currency – digital coins
5.9.1 The Services facilitate the conversion of "digital coins" ("silver coins") into a currency that can be paid to the user via 2Again's selected and recognised payout solutions if you as a user have a paid subscription.
5.9.2 Silver coins can only be paid if you have a paid subscription.
5.9.3 The minimum withdrawal amount is 8000 silver coins. The minimum amount is subject to change by 2Again without notice.
5.9.4 The value of silver coins may vary depending on the tax and VAT rules of the country where you reside and are liable to tax.
5.9.5 Silver coins are held on your profile and can be withdrawn as long as you maintain a subscription. If you choose to cancel your subscription and downgrade to a free profile, your earned silver coins will be held on your free profile for 90 days before being permanently deleted without the possibility of compensation for lost silver coins after 90 days.

6. Other third-party services
6.1 The Services may contain banner advertisements and advertisements from third-party platforms and external resources, for example, third-party websites or mobile apps, social networks, etc. ("Third-party Platforms").
6.2 2Again is not liable for the availability or accessibility of such Third-party Platforms. If you choose to interact with Third-party Platforms made available through the Services, the terms and conditions of such platforms will govern the relationship between you and them. 2Again is not responsible, including liable, for the terms and conditions or actions in relation to Third-party Platforms.
7. Communication between 2Again and user
7.1 2Again may regularly inform you of relevant, technical, and legal information, e.g., updating the algorithm, changes to the Terms or the like via the email address you have provided in your user profile, as a message in the Services, via push notification, chat function, or similar.
8. Interaction with other users
8.1 2Again strives to promote a respectful user experience through the features of the Services, but 2Again is not responsible for the behaviour of users in the Services.
8.2 2Again encourages you to exercise caution in your interactions with other members, especially if you decide to communicate with people elsewhere than through the Services or when meeting with people in real life.
8.3 You are solely responsible for your interactions with other users. 2Again does not conduct background checks and does not otherwise conduct investigations into the behaviour or background of its users.
8.4 2Again cannot guarantee that all content will be in accordance with the Terms or the law. If you come across content on the Services that violates the Terms or the law, please report it in the Services.
9. Ethical rules
9.1 2Again reserves the right to assess and remove content that violates applicable law or the Terms.
9.2 By using the Services, you agree that their use is subject to applicable law and the Terms, including agreeing that you will not:
- Use the Services for purposes that are illegal or prohibited by the Terms or by applicable law
- Use the Services for any harmful or criminal purpose
- Use the Services to inflict damage on 2Again
- Spam, request/"beg for" money from, or deceive other users
- Use the Services for your own gain or for systematic cheating
- Impersonate a person or send pictures of another person without his/her permission
- Bully, stalk, intimidate, assault, harass, mistreat, or defame other users
- Post content that violates or infringes anyone's rights, including the right to privacy, copyright, trademark law, or other rights relating to the right to intellectual property or contractual rights.
- Post content that includes hate speech or threatening, sexually explicit or pornographic content, paedophile content, content that incites violence, or content that includes nudity or graphic or gratuitous violence
- Post content that promotes racism, prejudice, hatred, or physical harm of any kind against any group or individuals
- Request passwords for any purpose or request personal information for commercial or illegal purposes from other members, or disseminate personal information about another person without his or her permission
- Use another user's profile
- Create another profile if 2Again has suspended or removed your profile unless you have 2Agains permission to create a new profile
9.3 2Again reserves the right to investigate and/or suspend or delete your profile or disclose information to authorities if you have violated the Terms, abused the Services or acted in a way that 2Again considers inappropriate or illegal, including through actions or communications via the Services.
10. Operation
10.1 2Again seeks to avoid errors, omissions, and disruptions to the Services always, but this may occur. 2Again is happy to receive information on such matters and will at any time seek to remedy such matters as soon as possible.
10.2 2Again shall not be liable to you as a user in the event of errors, defects, malfunctions, or removal of functionality.
11. Tax
11.1 Amounts you have earned through the Services must be stated on your tax return to SKAT.
11.2 Any disclosure or notification of income obtained through the Services to SKAT is your responsibility, and 2Again is not responsible for this.
11.3 2Again will provide information to the tax authorities if 2Again is obliged to disclose the information. 2Again will, in such situations, fully cooperate with the tax authorities.
12. Rights and licensing
12.1 Rights
12.1.1 2Again holds all rights, including proprietary rights, copyrights, patent rights, trademark rights, etc., to the Services.
12.1.2 The Services use software to which the rights belong to third parties but to which 2Again has the right of use.
12.1.3 2Again reserves the right to initiate legal proceedings against anyone who infringes 2Again's intellectual property rights.
12.2 Right of use
12.2.1 Upon acceptance of the Terms, you obtain a time-limited, revocable, non-exclusive right of use to use the Services. No other use of the Services is permitted without special agreement with 2Again.
12.2.2 Your right of use is always subject to your maintaining a user relationship with 2Again. If your agreement with 2Again terminates – for any reason – you must immediately cease use of the Services.
12.2.3 You may not imitate, imitate, or copy any material that you have directly or indirectly accessed through 2Again in a manner that is likely to misinform or discredit 2Again. In the same way, you must not contribute to the use of 2Again's business characteristics in a way that may cause a risk of confusion with other characteristics.
12.3 Third-party rights
12.3.1 In 2Again's view, the Services do not infringe the rights of third parties. If you become aware that the Services infringe or are alleged to infringe the rights of third parties, you must immediately notify 2Again of this and cease any use of the Services. Similar information must be provided to 2Again if you are met with a claim for damages or the like from a third-party based on your use of the Services. As far as possible, you must assist 2Again with the investigation of any infringement of rights.
12.3.2 2Again is entitled, but not obligated, to assume control of any legal or settlement negotiation in which you are involved that relates to the Services. 2Again will bear your reasonable costs for your participation in the litigation or settlement negotiations until such time as 2Again may announce that 2Again will conduct the litigation or settlement negotiations.
12.3.3 If a judgment or settlement is reached according to which the Services infringe the rights of third parties, 2Again will pay awarded damages, indemnity and the like or settlement sum to third parties if you have complied with your obligations. Furthermore, 2Again is obligated, at its sole discretion, to either a) allow you to access a new version of the Services within a reasonable time that does not infringe the rights of third parties or b) terminate the agreement with you. Also, you cannot make any claims against 2Again in such a case.
13. Default
13.1 Failure to comply with the Terms is a material breach that may result in the termination of your agreement to use the Services.
13.2 Any automated use of the Services, manipulation or misuse of this or 2Again-relevant data, violation of the law, 2Again's ethical rules, mass creation of profiles, and other systematic exploitation of the Services and the like is a material breach of the Terms and will result in the deletion of your profile.
13.3 2Again uses a variety of electronic tools to detect misuse of and intrusion into the Services, which automatically alerts 2Again in such situations.
13.4 In cases where there is a violation of criminal legal provisions, this will be reported to the police.
14. Deletion of profile etc.
14.1 Suspension
14.2
14.2.1 2Again is entitled to suspend your profile at any time if 2Again finds reason to do so, including in connection with 2Again's investigation into misuse of the Services. If your profile is suspended, you will not be able to use the Services. In this case, you will be notified of this via the Services or other contact information.
14.2.2 No later than 30 days after the suspension, 2Again will either lift the suspension or delete your profile, cf. also clause 14.2.4.
14.2.3 You cannot make any kind of claim against 2Again if it turns out that the suspension was wrong.
14.3 Deletion
14.3.1 You are entitled to delete your profile at any time. Such deletion can be accomplished via the Services in your profile settings.
14.3.2 If you delete your profile, any deposits, including silver coins, virtual items, or the like, will be lost.
14.3.3 2Again is entitled to delete your profile at any time if 2Again finds reason to do so.
14.3.4 2Again does not make any payout of deposits if there is evidence that you have misused the Services or breached the agreement with 2Again, and 2Again, therefore, deletes your profile for the aforementioned reasons.
14.3.5 Upon deletion of your profile, it will be deleted immediately, but no later than 48 hours after the request for deletion has been received.
14.3.6 After deleting your profile, it can no longer be used or recreated.
14.4 2Again will store certain information about you even after deleting your profile. See about 2Again's processing of personal information in 2Again's Privacy Policy.
15. Liability
15.1 The Services shall be made available in their present form as they are and exist. Any use of the Services is at your own risk, and in no event shall 2Again be liable for any use of the Services. Your use and use of information of any kind made available on the Services is at your own risk.
15.2 In no case can 2Again be held liable for indirect losses, including but not limited to consequential damage, lost earnings, operating losses, loss of data, or other indirect losses suffered by you as a user or by third parties. This applies regardless of whether 2Again has been informed of the possibility of such a loss and regardless of whether 2Again can be blamed for the loss, and regardless of the degree of negligence.
15.3 2Again is entitled, at any time and without prior notice, to change the content of the Services.
15.4 2Again does not warrant and is not responsible for the accuracy or completeness of the content of the Services, including for any delays, inaccuracies, errors, interruptions, or omissions that may occur.
15.5 In no event shall 2Again be liable for any use of the Services, including for acts or omissions made in reliance on the information contained on the Services, failure to access the Services, loss of data, business interruption, system failure or similar loss, and other consequential damages, whether or not 2Again has been aware of any errors or omissions on the Services.
16. Force majeure
16.1 Neither party shall be liable for any failure to comply with the Terms or any damage suffered by the other party as a direct or indirect consequence of the party being affected by force majeure. Force majeure includes, among other things, war, mobilisation, natural disasters, strike, lockout, fire, water damage, trade restrictions, virus or hacker attacks, breakdowns or failures in communication systems, power failures, subcontractors' force majeure, and other unforeseen circumstances that the party concerned could not prevent by exerting reasonable efforts.
17. Disputes
17.1 If any disputes arise between you and 2Again regarding the use of the Services, the Terms are governed by Danish law, including the rules on choice of law and jurisdiction to the extent that you can legally enter into such an agreement under applicable law, with the exception of Danish law's rules on international choice of law and jurisdiction.
18. Translation
18.1 If there is discrepancy between the Danish version of the Terms and the translated version, regardless of which language version, the provisions of the Danish version of the Terms shall prevail.
19. Changes
19.1 2Again may change these Terms at any time and without notice. The latest version of the Terms can be found in the Services.
19.2 You will be notified of changes to the Terms via the email address you have provided in your user profile, as a message in the Services, via push notification, chat function or similar. If you do not agree to the amended terms, you will no longer be able to use the Services, and 2Again is entitled to delete your profile.
20. Version
20.1 These Terms were last updated in April 2022 and replace all previously applicable Terms.
